They don't have to charge you with anything. They can take you to jail, have you sit there overnight and then release because they aren't going to charge you. Happened to many friends, they'll just stick them in the drunk tank and then let em go in the morning.

Land of the "frankly we'd rather not have drunks wandering the streets, potentially harming themselves and others." Yeah it's kinda harsh, and I doubt I'd enjoy it if it happened to me, but they're playing to the odds.

At least if you see a group (and by group I mean 3 at least) of drunk dudes walking down the street, you better hope you have some backup because thats how fights and shit start. Seen too many fights because group 1 walks by group 2 and someone just can't keep their mouth shut.
