Similar 'fortress' mods/games and Valve - where is the line drawn?

I've read a post on Slashdot about valve threatening a fortress game because it's too similarily played like the original game (even though it's just Quake gameplay with flag capturing and classes with abilities) especially if it's not a Goldsrc/Source game dependent production, and you can't copyright gameplay mechanics.

Is this the foxiness the same with CStrike and DoD gameplay too?

These matters concern me because I am making a free fortress game that is different in names and style anyway that could potentially pose a danger to TF2 sales.

Doesn't it even really matter anyway? I mean, the dev. team isn't getting money out of that. If someone chooses the other game, it's called an opinion. But selling is far worse because then they'd be basically stealing another company's money.

Even SELLING should be legally okay with the same gameplay rules (given the appropriate engine license, content data from scratch, and new IP)

i'm just curious since Valve is a Microsoft-influenced company in which they might share an anti-competitive view.

Valve is not threatening BMS anymore than they are threatening FF. In fact, these two mods have gotten blessings from Valve. I don't know who they elegedly threatened.... but given that Valve isn't losing money, and in fact can gain money with no investment(other than some mentions in their news posts).... I don't think you will see Valve ever threaten a legitimate Mod. After all, they give out the tools to make a compatible game with the purchase of their games. Mods make them stronger, and they know it. They will always be ahead of the curve, so to speak, because they control the actual engine.

They're not the same category because the execution of them depends upon the purchase of one of their games. If it's for something not related to their own sales, then that will raise their eyebrows.
