Carpenter's Union members are all homosexual?

Labor dispute in Las Vegas

A business owner in Las Vegas, as part of an ongoing labor dispute, hangs out a sign that reads:

Quote:

"CARPENTERS UNION MEMBERS ARE ALL HOMOSEXUALS AND THATS WHY THE IRON WORKERS ALL HAVE TO BEAT THEM UP!"
Oh c'mon now... Don't we have one or two Vegas residents on these forums? Have you seen the sign?

Do you guys believe this kind of thing deserves 1st amendment protection?

o_jinx 01-29-2007 03:50 PM

Isn't it intended slander or libel?

Also, it is so obviously stupid that it reflects more poorly on the person saying it.

o_|404|innoc-tpf- 01-29-2007 03:59 PM

Slander is spoken and libel is written so of the two it's potentially libel. I agree that it reflects poorly on the author...but does it deserve 1st amendment protection? Is libel ok under that circumstance?

o_uber 01-29-2007 04:16 PM

People always demand freedom of speech and the First Amendment, so long as it abides to what they agree with.

That doesn't necessarily mean I agree with the message. Contrast with my first quote in my signature. It was terrible business move and totally unprofessional, but we must weigh liberty with nuisance. A true American will always favor the former.

Protected speech isn't absolute Uber. There are limits. Does this mean that you think the banner would qualify as protected speech? Honestly, it does edge dangerously close to libel as I read it.

o_psycnet 01-29-2007 06:10 PM

For once I agree with Uber. It isn't hate speech, and should be protected by the 1st as the 1st is written.

Of course, I'm agreeing on purely libertarian grounds. The result of whether he's slapped with a successful libel suit or not is purely up the America's wishy-washy up and down court system (and lawyers)

o_ihmhi 01-29-2007 06:54 PM

Slander or Libel as I understand it is basically an untrue statement. If I say Donald Trump's head looks like a badger died on it and stayed there, that is probably not slander because it has some truth to it. But if I were to say that The Donald is a raging homosexual and he is not, then it is slanderous because it has no truth in it.

So basically... if even one of those workers is as straight as the day is long, then the statement is libellous.

o_|404|innoc-tpf- 01-29-2007 07:54 PM

So if we agree it's libelous is it something the Gov't can make them take down or do you see it as strictly a civil matter?

Circuitous 01-29-2007 09:10 PM

Doesn't it need to have some effect on the target's social standing? This is so obviously bullshit that I don't think it's really hurting them.

It's free speech but it ain't smart speech.

o_nezumi 01-30-2007 11:49 AM

If the carpenters think it's negatively impacting their business (or wellbeing or whatever) then they probably have some grounds to attempt a suit, at least.

Like, if Burger King were to say McDonalds burgers containg ground up rat then they'd probably be liable. This issue is a little more grey but I dunno. I'm sure the carpenters lawyers could make something out of it.

I think the rule of thumb, though, is that our liberties stop at the point where they start infringing on the liberties of others. For example, we have freedom of religion- but if your religion involves cannibalism, that part of it ain't happening here, because it infringes on the right of other citizens not to be eaten.

Similarly, a KKK parade or rally isn't protected because it is nothing but racist hate speech.

There are also people like bl4h, who not only don't deserve free speech, but should probably be gagged on general principle for the well-being of society. ;)

o_uber 01-30-2007 05:39 PM

Actually a KKK parade is protected. Again, people demand freedom of speech so long as they agree with what's being said.

It's no surprise college students overwhelmingly demand freedom of speech. But when asked if they should allow an Ku Klux Klan member to speak at their school they vehemently reject the idea.

If they do, they should get ready to be beat the fuck down by those who oppose them. Something similar happened at a campus around here not too long ago.

Yeah man....I took a boss job in vegas over the phone. I was in michigan and I flew out a week after the calls to work out the details. But when I go to the shop there was this massive Protest going on...like 250 people.....I ran my 3/4 ford over the line bouncing people of my side mirrors......

It's quite the epic story...I am willing share it over several posts. But I need at least 3 of you to show post asking for more.......like the time the owner gave me 500 bucks to go to Gander Mountain and buy every can of animal piss I could, a 5th of Everclear and a 4 gallon spray bottle to mix up a batch of Anti-Protester Spray.........LMFAO

So we got one spectator ...can we get at least 2 more ?
